The recount for the 11th Senate District seat is almost at an end. Incumbent Republican Frank Padavan leads Democratic City Councilman Jim Gennaro by 582 votes with only about 250 paper ballots left to examine. That should put the race out of reach for Gennaro, who does not have enough ballots remaining to make up a 582 vote shortfall.
However, Republicans may have overplayed their hand. With approximately 2000 paper ballots out of the total 8000 having been invalidated by bi-partisan Board of Elections staff in advance of the official recount, the democrats at the 11th hour now vow to take their case to court in order to have the 2000 previously invalidate ballots declared valid. Democrats are claiming that voters, especially minority voters in this district, are being disenfranchised.
disenfranchisedThe first mistake the republican team made was to allow the highest ranking republican at the Queens Board of Elections, Katherine James, to be removed from the recount. James, a long-serving official at the Queens Board, is also African-American and would not have been a party to any effort to invalidating ballots of minority voters.
The Republicans in charge of the recount, John Ciampoli, an Albany election lawyer, and John Haggerty, who is ostensibly serving as Ciampoli's paralegal (although not a licensed paralegal and not preparing any of the briefs according to insiders), inexplicably caved to a request from democratic lawyers that James be substituted for someone from outside the borough and with less experience than James.
Why there was an objection to James working on the recount is unclear, as is the reason the Republicans caved in and allowed her replacement.
Democratic commissioners at the Board are threatening not to vote in favor of certifying the results, and more alarming is that at least one Republican Commissioner is also concerned about voter disenfranchisement due to the involvement of John Haggerty in the recount, who is notorious for his tactics in invalidating minority voters' ballots. Haggerty has long been rumored to have used inappropriate tactics in other recounts around NY.
Bringing in an operative with this baggage when it is fairly clear Padavan has the votes seems to have played right into the hands of Democratic recount leaders Reich and Boyles and Democratic operatives from the Parkside group who are playing up every perceived slight for the media. Indeed today's court proceedings were delayed by up to 45 minutes by Reich's press conference before the hearing.
For years Haggerty and his brother Bart have fought the Queens GOP organization, often undermining their efforts to rebuild the party or support candidates, by filing numerous frivolous lawsuits over the bi-annual election of the county party Chairman. Many are quietly pointing the finger at Haggerty for weakening Sen. Serf Maltese to the point where he almost lost his reelection in 2006 and was finally dethroned this year.
this yearDemocratic District leaders have routinely credited the Haggerty brothers with exposing Maltese's weakness and "putting blood in the water" which ultimately resulted in Maltese's defeat this year and the toppling of the Senate Majority.
However, Haggerty, who was a Pataki staffer, made many friends as Pataki's dispenser of patronage and has apparently gotten a pass from leaders in Albany on his relentless attacks on Senator Maltese and the Queens GOP.
The ultimate mystery in this strange case is this: Why would the Senate leadership send Haggerty to help defend Padavan when he has been undermining Queens elected officials for years and a Padavan loss would increase the likelihood of a successful Haggerty challenge to the current GOP leadership?
GOP leadershipAll the more given his alleged relationship with Democratic officials and Democratic operatives at the Board of Elections representing clients on election law matters. Although not a licensed attorney Haggerty routinely represents Republican and Democrat Candidates at the Board of Election hearings using what have been described as hardball or questionable tactics making him as many friends as enemies.
Republicans need to keep a close eye on this and make sure that a loose cannon operative like Haggerty doesn't undermine the efforts of Republicans to keep this critical Senate seat to further his own agenda. Republicans appear to have the numbers but seem to be outmaneuvered by the Democrats at every turn, first in the public relations department and now in court.

The Dems are full of sh-it and have been all along. It is a mathematical improbability to sqeeze out the numbers they need for Gennero. If they have run through 6,000 paper paper ballots and Padavan is still up 580 with only 252 in the judicial review box (the "Box") even if every ballot in the Box was a Gennero vote Padavan would still have a lead of 328. As it is some portion in the Box are probably for Padavan or "No" votes (folks who just voted for Obama and not the whole line). A bipartisan board that leans over backward to validate ballots only initially identified approximately 2000 for invalidation out of 8000 paper ballots in advance of the recount and are known to have reworked them extensively to bring the number down to 1700. Ask yourself what kind of error rate would be necessary to allow Gennaro to actually win. Even a 20% error rate would be insufficent because somewhere between 40% to 50% of the invalidated ballots are for Padavan. What do they need to win? 30% or 40% error rate? Fraud for Gennerao. Ballots in teh back of someone's trunk to appear? Padavan's legal team may or may not be making a muck of the recount. It is unclear at this time but they certainly are losing the public relations war.
For Gennaro to even have a shot then he would need over 300 or 400 of the previously invalidate ballots to be for him. That mean they need to revalidate up to 600 to 800 votes. The Dems probably know they can't win but want a propaganda victory and they are getting one. Shades of Florida. With the stakes as highas they are one has to ask way the GOP Senate handled this like this.

Pataki ran our thriving NYS-GOP into the ground with his enormous ego. His fear of enlisting, promoting and farming other talented and capable Republicans to keep the party strong, literally put the NYS-GOP in a state of ruin. John Haggerty can be thanked for that, too. Haggerty's style worked well with Pataki's. His ego and old school "good old boy" political mentality did, and do, nothing to help the GOP. Haggerty is only driven by his unquenchable thrist for personal gain, power. He has fooled many in the party by seeming like a team player, when in fact he is a misogynistic, racist, self-serving egotist. He is a sneaky guy and plays dirty with his "team" and his enemy. Helping the overall good of the NYS-GOP is not a part of his agenda.

It is amazing to me that anyone in the NYGOP answers Haggerty's phone calls, much less gives him any responsibility. He is the biggest slacker and scam artist going.
Not to mention he has been working with the Dems here against the GOP for years. His unholy alliance with the highly corrupt Stanley Schlein, the bronx dem election lawyer who orchestrated the coup against Rivera this year, has wreaked havoc on both the GOP in NYC and the city Board of Elections.
Haggerty's illegal activites at the Board need to be stopped, and it's a shame that good people at the BOE will likely lose their jobs in the near future thanks to Haggerty's meddling and acting like the king-maker at the Board.

I don't know the Haggerty's personally, but it seems to me that John Sr.'s judgement on issues important to Republicans should be questioned...
"In March, the Albany Times Union reported that Mr. Haggerty was resigning his $99,425-a-year job heading Governor Pataki's legislative affairs office to take up a post as Mr. Bloomberg's deputy campaign manager."
So, in 2005, Mr. Haggerty went from being a Pataki staffer to a Bloomberg Campaign staffer? He went from a guy who ran NY State like an authoritarian liberal to a guy who used and abused the GOP line as long as it suited him and was part of a direct effort to undermine a longtime Republican Councilman who, reasonably, wanted to run against a liberal Republican (at the time) incumbant Mayor?
This is the guy who "knows more" than "the grey men" running the party now?
Seems like these guys are for hire and what is in the best interest of the GOP doesn't seem to be what is of importance to them.

Haggerty controls the Board of Elections, that is why Bloomberg hired him.When he says jump, the Board asks how high.
At any given time, he makes one call and gets what he wants.
He was able to manipulate votes and get Ognibene off the ballot and Bloomberg will forever be indebted.

I remember in the early 80s as a young man in GOP Young Republican meeting a brilliant attorney named John Haggerty Sr. in Albany, he managed to spearhead efforts to grow the party and brought respect to our party in the senate.
Sadly, the legacy isnt being carried on.The apple fell so far from the tree it rolled across the street.

Reading the comments of But Seriously made me laugh and realize how serious this matter really is. That anyone would defend this guy who has wreaked havoc on the party is mind boggling.
First of all, why would Maltese listen to someone who has relentlessly undermined him for years, as Haggerty has done? John Haggerty systematically weakened Serf until he finally became vulnerable.

He knows about Queens? What does he know? Show me any evidence of that? He is so pathetic he can't even win a district leadership race in his own community. His own allies talk about how screwed up he is.

As one commenter mentioned, Haggerty's father was senior counsel to the Seante Majority Leader's office for many years, and was a wel-respected man in the party. It seems that his future-less son was given some patronage jobs first with Pataki and then Bruno.
With Pataki he was the guy who delivered the funding payoffs for all the other elected officials and therefore created a lot of sympathy for him. But he finally blew that job and then blew his next gig with the Senate.
He was pushed off on Bloomberg in 2005, who was sold a bill of goods. But he was able to use his BOW connections to knock Ognibene off the ballot. I guess Bloomie did get his monies worth on that one.
After petitions, he was supposed to help run outreach to the republican party and republican council candidates, but never returned a single phone call from any of the candidates I ever spoke with. He was a no-show for the party.
Since then he has floated around in the shadows turning up in odd places like working for Fossella in Staten Island and with Treadwell in Westchester, as well as other Pataki cronies who would pay him a few bucks to work on their petitions.
The really messed up part of this is how he has managed to parlay all these relationships into gaining power at the NYC BOE. He formed a relationship with Stanley Schlein, who was the Bronx Democratic Party election lawyer.
Schlein's former wife was a BOE commissioner, so he was able to influence her vote on the Board and eventually used his powerful position to influence other dem commissioners as well.
Haggerty was able to use his relationships with the SI GOP and the Senate Majority Leaders office to influence a number of GOP commissioners.
It was then Haggerty and Schlein who engineered the hiring of the current Executive Director, Marcus Cederquist (a Haggerty apparatchik), even over the objections of the Bronx and Queens GOP who each had a former BOE commissioner interested in that position who each would have ostensibly been more qualified for the job than Cederquist.
Together, Haggerty and Schlein hold power over the two top officials at the Board and a minimum of 5 commissioners at all times. They were successful in blocking the recent attempt to fire George Gonzalez from the #2 position under Cederquist.
The recent coup in the Bronx to oust Rivera and the multiple attempts by Haggerty to take control of the Queens organization is all about gaing control of the ability to appoint commissioners for those two organizations.
In a Svengali-like fashion they can have anyone at the Board hired or fired, but thay can't appoint the commissioners. Only County Chair's can do that. They can however block those appointments as they did with Vince Tabone from Queens recently.
It goes on and on and is a truly corrupt story. And a frighteneing one as well. Not only do they control the votes, they also have candidates as clients that they represent at the Board. This is a clear conflict of interest.
Haggerty has also been pushing for the Board to purchase the Sequoia voting system, acting in an appearant illegal manor as a lobbyist on their behalf. Interestingly, Sequoia is also a client of Al Pirro. These relationships are so intertwined and messed up it is beyond shocking. Someone will hopefully expose dall this someday.

If anyone should doubt the fact that Haggerty works to undermine republicans in NYC, all one has to do is look at his efforts to get the challenge to Anthony Como's petitions moved out to Staten Island where his could control the review process and have Como's petitions invalidated by his allies at the SI Board of Elections.
This was done in coordination with the Queens democrats and their election lawyer Reich.
How any elected official can get in bed with this obviously shady and corrupt character should give us all pause.
Bloomberg has the most to lose here, since he is in bed with Haggerty and has been since his 2005 campaign. Haggerty regularly claims to be acting on authority of the Mayor (as he did previously with Pataki). While Bloomberg has complained about the BOE recently, he has not made as much of an issue as he could because he would be undermining Haggerty and his boy Marcus.
Bloomberg has decried partisanship at the Board, when in fact the real problem is the influence peddling by Haggerty and Schlein for personal gain as opposed to how the process should work to protect the integrity of the political process.

So it seems with the Count done, Frank is up 580 votes... of course now the matter has moved to court Justice Kerrigan (appointed to run by the very Democratic machine that is bringing the process into court), will need to address whether or not the ballots invalidated by the Board of Elections can be re-examined under the claim that SOMEHOW the BOE commissioners (one republican and one democrat) were biased against hispanic and asian persons casting affidavit ballots-
the party would do well to consider such a claim smacks of civil rights and voting rights act issues which are LARGER than state court.... perhaps they should pre-empt the Dems and pull the matter into EDNY Federal Court to prevent the bias of a democratic machine's NY State Judge can't put the finger on the scales of justice....
At least the Federal system TENDS to be far less forgiving with frivilous lawsuits....

I’d like to chime in here about the Queens Republican Party. I’ve been active in NYC politics for many years now. At times I’ve certainly been outspoken about the shortcomings of our Party and the County Committee operations.
But what I’ve seen in the last year since Phil Ragusa became Queens GOP Chairman has been very encouraging. Chairman Ragusa may bear some resemblance to the “gray men” one commenter described, having spent many decades dedicated to working for the Republican Party.
However the rest of the organization is made up of bright, energetic and talented people my age (early 40’s) and younger. A quick look at the website www.qgop.com will show to what degree the party has been modernized and there are many initiatives still in the planning stage.
Many people may complain that more is not being done fast enough. Of course, it is easy to complain. I have done my fair share over the years. However, I always backed up my complaints with action, doing what I thought others should be doing. Anyone who thinks they can do better should do more than just talk. They should do something to actually build the party and establish themselves as legitimate leaders and not just the opposition.
Leadership by example is the only kind that matters in politics. And I know from working with Chairman Ragusa over the last year that he is open to anyone who wants to step up to the plate and work on behalf of the Party (as opposed to those who just work for their own benefit).
I have never sought to be part of the “organization” but I could not be more proud to be part of the Queens GOP under Chairman Ragusa.

I am unimpressed by Ragusa. He himself had a terrible race against Avella several years ago in what used to be a GOP seat on the city council. He also has a much trouble remembering people's names. Putting "headquarters" in Bayside, far from public transportation, is also a big mistake. He should have put it closer to Astoria or anywhere which can be easily reached by people who work in Manhattan. His inability to remember who people are is astonishing. He also was a Bloomberg supporter.

Working at the Board of Elections is not exactly a stepping stone to corporate success. This story is an overblown hit piece. I know people who turned down jobs there and preferred working as temps. This is a tempest in a teapot.

Well, it looks like the warnings that Padavan's legal team could be endangering his chances of winning are being realized. Yesterday a judge ordered that the 1800 paper ballots previously ruled invalid by the BOE be reviewed again to determine if they can be found to be legitimate by any means or excuse.
This si in spite of teh fact the the guys running the recount for Padavan were repeatedly told by Queens GOP lawyers that they were not handling this properly and risked this action by the judge. Ciampoli and Haggerty were not prepared for tihs motion.
Now Padavan looks likely to lose. Oddly enough, it helps Haggerty who more than likely plans to challenge Queens GOP Chairman Phil Ragusa for the leadership this fall. Without Padavan to help keep the county committee in line, Haggerty seems more likely than ever to wrest control of the party from Ragusa and installing his puppet at the Board of Elections to further insure victory for his clients/candidates.
First he screwed Maltese, then he tried to screw Como, and now Padavan. When will republicans learn that dealing with John Haggerty is the kiss of death?

Whatever we think of the factions in the Queens GOP it is clear at this point that the legal strategy thus far has not worked. We MUST salvage the situation at all costs.
In talking with another attorney and Queens GOP'er we lamented the tactical decisions in the case and I, as a litigator, and he, as an Appellate Advocate, both concluded that without a radical change in force and direction, the Padavan election was in jeopardy. Other insiders in the party reached the same conclusion both with and without a law degree.
The problem in a nutshel is twofold- first the entire case has IMHO been fought from a defensive posture, without forceful advocates pushing back and harder than the other side.
The second problem is the lack of coherent direction to take the fight in- without a unity of purpose, its always difficult to steer ANY lawsuit, let alone one as complex as this.
Someone needs to take this up the street before its too late for Frank- who certainly doesn't deserve to lose because of legal apathy.
Litigation is WAR. Take no prisoners should be the modus operandi here.
